Terms of Use

These Terms of Use ("Terms") govern access to and use of the American Wellness Pharmacy Provider Portal (the "Portal"). By submitting a provider application or using the Portal, you agree to these Terms.

1. Eligibility

The Portal is intended for licensed healthcare providers and their authorized clinic staff. By applying, you represent that you are a licensed healthcare provider authorized to prescribe medications, or an agent duly authorized by such a provider, and that all information you provide is accurate and current.

2. Account responsibility

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify AWP promptly of any unauthorized use. Credentials may not be shared outside your authorized clinic users.

3. Accurate information

You agree to provide and maintain accurate clinic, provider, licensing, and prescribing information. Certain identifying details (such as clinic name and NPI) are used to key your account and can only be changed by contacting AWP.

4. Permitted use

The Portal may be used only for legitimate, lawful ordering of compounding and pharmacy services for patients in the course of authorized clinical practice. You agree to comply with all applicable federal and state laws and professional standards, including those governing prescribing and controlled substances.

5. Prohibited use

You may not use the Portal to submit fraudulent, inaccurate, or unauthorized orders; to access data belonging to other clinics; to interfere with the operation or security of the Portal; or for any unlawful purpose.

6. Application and approval

Submitting an application does not guarantee Portal access. Approval is subject to verification of credentials and remains at AWP's discretion.

7. Suspension or termination

AWP may suspend or terminate access for any account that violates these Terms, that provides inaccurate information, or where required to protect patients, the public, or the integrity of the Portal.

8. No warranty; limitation of liability

The Portal is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, AWP disclaims implied warranties and is not liable for indirect or consequential damages arising from use of the Portal. Nothing in these Terms limits any liability that cannot be limited under applicable law.

9. Governing law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules.

10. Changes to these Terms

AWP may update these Terms from time to time. Continued use of the Portal after an update constitutes acceptance of the revised Terms.
